  1. Introduction

This website, accessible at https://punkrave.co.za/ and any related mobi-sites, online stores, software applications, or digital platforms, is owned and operated by Simas Corporation (Pty) Ltd T/A PUNK RAVE, a private company registered in the Republic of South Africa with registration number 2019/162925/07.

In these Terms and Conditions, “PUNK RAVE”, “Punk Rave SA”, “punkrave.co.za”, “we”, “us” and “our” refer to Simas Corporation (Pty) Ltd T/A PUNK RAVE. “You”, “your”, “customer” and “user” refer to any person who accesses or uses the Website, creates an account, places an order, purchases Goods, or communicates with us through the Website or any related channel.

These Terms and Conditions govern your access to and use of the Website, the ordering, sale, fulfilment, delivery and return of products purchased from PUNK RAVE, and any related services provided by us.

By accessing or using the Website, creating an account, placing an order, clicking “Buy”, “Order”, “Checkout”, “Register”, “Subscribe”, or any similar button, you confirm that you have read, understood and agreed to be bound by these Terms and Conditions.

If you do not agree to these Terms and Conditions, you must not use the Website or place an order.

  1. Important notice

These Terms and Conditions apply to users who are consumers for purposes of the Consumer Protection Act, 68 of 2008 (“CPA”), where applicable.

Certain clauses in these Terms and Conditions may:

  • limit or exclude the risk or liability of PUNK RAVE;
  • create risk, responsibility or liability for you;
  • require you to indemnify PUNK RAVE or another person; or
  • serve as an acknowledgement by you of certain facts.

These clauses are important and must be read carefully.

Nothing in these Terms and Conditions is intended to unlawfully limit, exclude or avoid any right or obligation created under the CPA, the Electronic Communications and Transactions Act, 25 of 2002 (“ECTA”), the Protection of Personal Information Act, 4 of 2013 (“POPIA”), or any other applicable South African law.

If any provision of these Terms and Conditions is inconsistent with applicable law, that provision will apply only to the maximum extent permitted by law, and the rest of these Terms and Conditions will remain valid and enforceable.

  1. Products sold on the Website

The Website enables customers to shop online for PUNK RAVE fashion, clothing, footwear, accessories, gift vouchers and related products, including gothic, punk, alternative and lifestyle items, as may be offered for sale on the Website from time to time (“Goods”).

Product descriptions, images, measurements, size guides, colours, materials and availability are provided to assist customers in making informed purchasing decisions. We take reasonable steps to ensure that the product information displayed on the Website is accurate, but we do not guarantee that images, colours, sizing, textures or other visual details will display exactly the same on every screen or device.

Colours may vary depending on lighting, photography, screen settings, device settings and manufacturing batches. Minor variations in colour, finish, texture, stitching, trim, embellishments, lace, buckles, studs, straps or other design details do not automatically mean that the product is defective.

  1. Registration and use of the Website

You may browse the Website without creating an account. However, certain functions, including placing orders, viewing order history, saving addresses, or accessing account features, may require you to register as a user.

When registering or placing an order, you agree to provide accurate, complete and current information. You must not impersonate another person, use false details, or provide misleading information.

You are responsible for keeping your username, password and account details confidential. You agree that all activity under your account will be treated as activity authorised by you, unless you notify us immediately of unauthorised access or suspected misuse.

You may not use the Website:

  • for any unlawful purpose;
  • to submit false, fraudulent or misleading information;
  • to interfere with the proper working of the Website;
  • to copy, scrape, reproduce, distribute or commercially exploit Website content without our prior written consent;
  • to upload or transmit malware, viruses, harmful code or disruptive material;
  • to harass, abuse, threaten, defame or harm any person; or
  • in any way that infringes our rights or the rights of others.

By using the Website, you confirm that you are 18 years or older and have full legal capacity. If you are under 18, you may use the Website only with the involvement and supervision of a parent or legal guardian, who agrees to be bound by these Terms and Conditions.

  1. Orders and conclusion of sale

You may place an order for Goods through the Website by completing the checkout process and making payment using one of the available payment methods.

Placing an order does not guarantee acceptance of that order. PUNK RAVE may accept or reject an order depending on product availability, payment confirmation, supplier availability, stock accuracy, pricing accuracy, suspected fraud, courier availability, or any other reasonable business reason.

An order is accepted by PUNK RAVE when we confirm acceptance, begin processing or fulfilment, allocate stock to the order, place or confirm an order with our supplier or international warehouse, issue dispatch information, or deliver the Goods, whichever occurs first.

An automated order confirmation, payment confirmation or email acknowledgement does not necessarily mean that your order has been finally accepted. It confirms that your order request or payment has been received.

We reserve the right to reject or cancel an order before acceptance if:

  • the Goods are unavailable;
  • the listed price, description or availability was incorrect;
  • payment is not received or cannot be verified;
  • we suspect fraud, abuse, resale activity or unauthorised use of payment details;
  • the order appears to be duplicated or erroneous;
  • the delivery address is incomplete, incorrect, unsafe or outside our delivery capacity;
  • fulfilment is no longer reasonably possible; or
  • we are required or permitted to do so by law.

If we cancel an order before acceptance and you have already paid, we will refund the amount paid for the cancelled Goods, unless another lawful remedy applies.

  1. Stock availability

All Goods are subject to availability.

Some Goods may be held locally, while many Goods are fulfilled from our international warehouse, supplier network or distribution partners. Stock levels may change without notice.

Adding Goods to your cart or wish list does not reserve the Goods. Goods are reserved only once your order is accepted and processed by PUNK RAVE.

If an item becomes unavailable after you place an order, we may:

  • offer you a replacement item;
  • offer you a different size, colour or similar product;
  • place the item on backorder where possible;
  • issue store credit where appropriate and agreed;
  • refund the affected item where required or appropriate; or
  • cancel the affected part of the order.
  1. Prices and product information

All prices displayed on the Website are in South African Rand unless stated otherwise.

Prices, promotions, discounts, delivery charges and product availability may change without notice. The price charged will be the price displayed at checkout at the time you place the order, subject to correction of obvious errors.

We take reasonable care to ensure that prices and product information are accurate. However, errors may occur. If a product is listed at an incorrect price or with incorrect information due to a typographical error, technical error, supplier error, currency conversion issue, system error or other mistake, we may cancel or refuse the affected order and refund any amount already paid for that order.

We are not bound by incorrect information displayed on third-party websites, social media pages, search engines, cached pages, comparison sites or unauthorised advertisements.

  1. Payment

We are committed to providing secure online payment facilities. Available payment methods may vary from time to time and will be displayed at checkout.

Payment methods may include, subject to availability:

  • credit card;
  • debit card;
  • instant EFT;
  • electronic funds transfer;
  • bank deposit;
  • payment gateways available on the Website;
  • PUNK RAVE vouchers or store credit; and
  • any other payment method we make available.

Where payment is made by credit card, debit card, instant EFT or another online payment method, you warrant that you are authorised to use that payment method and that sufficient funds are available.

We may require additional information to verify payment, prevent fraud or confirm order details. We may delay fulfilment until payment has been received, cleared and verified.

For EFT or bank deposit payments, payment must be made within the period stated at checkout or in the payment instructions. If payment is not received within the required period, we may cancel the order without further notice.

  1. Delivery and fulfilment

PUNK RAVE delivers orders by courier or another delivery method made available by us.

Delivery charges are subject to change and will be displayed at checkout before payment is made.

Most orders are fulfilled from our international warehouse or supplier network. Fulfilment usually takes 2 to 7 working days after payment has been received, cleared and verified. “Working days” means Monday to Friday, excluding weekends and South African public holidays.

Fulfilment time and courier delivery time are separate.

The usual order process is:

  1. payment is received, cleared and verified;
  2. the order is processed and fulfilled;
  3. the order is dispatched or handed to the courier;
  4. tracking information is provided where available;
  5. courier delivery takes place.

Courier delivery time begins only once the order has been dispatched or handed to the courier. Courier delivery time is additional to the fulfilment period.

Delivery estimates are estimates only and are not guaranteed delivery dates unless PUNK RAVE expressly confirms a guaranteed delivery date in writing before you place the order.

  1. International warehouse fulfilment

You acknowledge and agree that many PUNK RAVE orders are fulfilled from an international warehouse, international supplier, distribution partner or non-local fulfilment channel.

International warehouse fulfilment may be affected by factors outside our control, including but not limited to:

  • supplier processing times;
  • international warehouse delays;
  • customs processing;
  • customs inspections;
  • freight delays;
  • courier delays;
  • public holidays in South Africa or other countries;
  • high-volume shopping periods;
  • stock allocation delays;
  • customs, import or export restrictions;
  • weather conditions;
  • strikes or labour disruptions;
  • transport network disruptions;
  • incorrect customer details;
  • force majeure events; or
  • other circumstances beyond our reasonable control.

We will take reasonable steps to assist customers and monitor orders, but PUNK RAVE is not liable for delays caused by international warehouses, suppliers, customs, couriers, third-party logistics providers, public holidays, strikes, weather, incorrect customer information, or circumstances outside our reasonable control.

  1. Orders required for events or specific dates

If you need an item for a specific date, event, festival, photoshoot, performance, birthday, wedding, holiday, function, trip or any other deadline, you must contact PUNK RAVE before placing the order so that we can advise whether the timing appears realistic.

PUNK RAVE does not guarantee delivery by a specific date unless we have expressly confirmed that specific delivery date to you in writing before you place the order.

Any fulfilment estimate, courier estimate, dispatch estimate, delivery estimate, product page estimate or general website estimate is not a guarantee that the order will arrive before your event or deadline.

Customers are responsible for ordering early enough to allow for:

  • payment clearance and verification;
  • order processing;
  • 2 to 7 working days fulfilment;
  • international warehouse processing where applicable;
  • supplier delays;
  • weekends;
  • South African public holidays;
  • international public holidays where applicable;
  • customs or logistics movement where applicable;
  • courier delivery time; and
  • possible delays outside our control.

A missed event, festival, photoshoot, performance, birthday, wedding, holiday, trip, function or other personal deadline does not entitle you to cancel the order, reject delivery, demand a cash refund, reverse payment, or claim compensation where PUNK RAVE is still processing or delivering the order within the applicable or agreed fulfilment and delivery timelines.

If you order too close to your required date, you accept the risk that the order may not arrive in time.

  1. Delivery address and customer responsibilities

You must provide a complete, accurate and deliverable physical address at checkout.

You are responsible for ensuring that:

  • the delivery address is correct;
  • the recipient’s name and contact number are correct;
  • someone is available to receive the parcel;
  • the courier can access the delivery address safely;
  • any estate, office park, building, reception or security access details are provided; and
  • you respond promptly to courier or PUNK RAVE communications.

PUNK RAVE is not responsible for failed, delayed or misdirected delivery caused by incorrect, incomplete or outdated customer information.

If a parcel is returned to us because of incorrect address details, failed delivery attempts, customer unavailability, refusal to accept delivery, or failure to respond to courier communications, you may be liable for additional courier, return, re-dispatch, storage or administration fees.

  1. Risk and delivery completion

Delivery is completed when the Goods are delivered to the physical address nominated by you, or to any person who appears to be authorised to receive the parcel at that address, including reception, security, building staff, household members, employees or representatives.

Once delivery has taken place at the nominated address, PUNK RAVE is not responsible for loss, theft, unauthorised use, misplacement or damage occurring after delivery, unless caused by our proven fault or where applicable law provides otherwise.

You must inspect your parcel as soon as reasonably possible after delivery. Any missing items, incorrect items, visible courier damage, tampered packaging or delivery concerns must be reported to us promptly at info@punkrave.co.za with photos of the parcel, packaging and items received.

  1. Delays and force majeure

All delivery and fulfilment timelines are estimates unless expressly guaranteed in writing by PUNK RAVE before the order is placed.

PUNK RAVE will not be liable for any delay or failure to perform any obligation where the delay or failure is caused by circumstances beyond our reasonable control.

These circumstances include, but are not limited to:

  • acts of God;
  • fire, flood, earthquake, storm or natural disaster;
  • war, invasion, civil unrest, riots or terrorism;
  • pandemic, epidemic, quarantine restriction or health emergency;
  • strikes, labour disputes, industrial action or work stoppages;
  • customs delays or customs inspections;
  • government action, restrictions, laws, embargoes or trade limitations;
  • supplier delay or international warehouse delay;
  • courier or logistics network failure;
  • port, airport, freight or transport disruption;
  • power failure, internet failure or telecommunications failure;
  • technical failure of payment gateways, hosting platforms or ecommerce systems;
  • cyber incidents or security events;
  • incorrect customer information;
  • high-volume periods such as Black Friday, festive season or promotional campaigns; or
  • any other event outside our reasonable control.

If a force majeure event occurs, our obligations will be suspended for the duration of the event. We will take reasonable steps to resume performance as soon as reasonably possible.

  1. Returns, exchanges, store credit and refunds

Our Refund and Returns Policy forms part of these Terms and Conditions.

PUNK RAVE does not offer discretionary cash refunds for:

  • change of mind;
  • incorrect size selection;
  • colour preference;
  • style preference;
  • customer ordering error;
  • unsuitable event timing;
  • missed events or deadlines;
  • delayed personal planning;
  • duplicate orders placed by the customer;
  • no longer wanting the item;
  • finding a different item elsewhere;
  • minor colour variation caused by screen or lighting differences; or
  • any other reason not required by law.

Where we approve a discretionary return of non-defective Goods, the remedy will usually be store credit, not a cash refund.

Store credit is not redeemable for cash and may be used only for future purchases from PUNK RAVE, subject to any terms that apply to the store credit.

Original courier, shipping, delivery, fulfilment or handling fees are not refundable and do not form part of store credit unless required by law or agreed by PUNK RAVE in writing.

Nothing in this clause limits any right you may have under applicable South African consumer law.

  1. Online cooling-off rights

Where ECTA gives you a cooling-off right for an online transaction, you may cancel the applicable transaction without reason and without penalty within 7 days after receiving the Goods.

If you exercise a valid statutory cooling-off right:

  • you must notify us in writing at info@punkrave.co.za within the required period;
  • the Goods must be returned to us;
  • the Goods must be unused, unworn, unwashed, undamaged and in their original condition and packaging, with all tags, labels, accessories and inserts intact;
  • you will be responsible for the direct cost of returning the Goods, unless the law requires otherwise; and
  • where a refund is legally required, the refund will be processed in accordance with applicable law.

The statutory cooling-off right may not apply to certain excluded transactions or Goods, including but not limited to Goods made to your specifications, clearly personalised Goods, Goods that by their nature cannot be returned, hygiene-sensitive Goods once opened or used, and any other Goods or transactions excluded by law.

This clause applies only where a statutory cooling-off right is available. It does not create an additional contractual right to return Goods outside the law or outside our approved returns process.

  1. Size exchanges

You must choose sizes carefully before ordering and refer to the size guide where available.

If you ordered the wrong size, you may request a size exchange within 10 days of receiving the item.

A size exchange is subject to:

  • written approval by PUNK RAVE;
  • stock availability;
  • the item being unused, unworn, unwashed, undamaged and unaltered;
  • the item being returned in its original packaging;
  • all tags, labels, accessories and inserts being intact;
  • the item not being excluded from return for hygiene, final sale, custom order or other reasons; and
  • payment of all applicable courier costs by the customer.

For size exchanges, the customer is responsible for the courier cost to return the item to PUNK RAVE and the courier cost to send the replacement item.

If the requested replacement size is unavailable, we may issue store credit instead.

  1. Items excluded from discretionary returns or exchanges

The following Goods may not be returned or exchanged for change of mind, wrong size, preference, event timing or store credit unless they are defective or returnable under applicable law:

  • lingerie;
  • underwear;
  • hosiery;
  • stockings;
  • bodysuits;
  • swimwear;
  • intimate or hygiene-sensitive items;
  • earrings or pierced jewellery;
  • cosmetics or body products;
  • consumable items;
  • custom orders;
  • made-to-order items;
  • personalised items;
  • special-order items;
  • items ordered through special arrangement;
  • pre-order items, unless otherwise agreed;
  • sale, clearance, discounted, promotional or final-sale items;
  • gift vouchers;
  • store credit;
  • items that have been worn, washed, used, altered, perfumed, stained, marked, damaged or repaired;
  • items without original tags, labels, accessories, packaging or inserts; and
  • any item that cannot be resold for hygiene, safety, legal or quality-control reasons.
  1. Defective or factory-fault Goods

If you believe an item has a factory defect, you must contact us as soon as reasonably possible at info@punkrave.co.za and provide:

  • your order number;
  • a clear description of the alleged defect;
  • clear photos or video of the alleged defect;
  • photos of the whole item;
  • photos of the packaging, tags and labels; and
  • any other information reasonably required to assess the issue.

A factory defect does not include:

  • normal wear and tear;
  • damage caused by misuse, abuse, neglect or accident;
  • damage caused by incorrect washing, drying, ironing, storage or care;
  • damage caused by failure to follow care instructions;
  • damage caused after delivery;
  • damage caused by alteration, modification or unauthorised repair;
  • damage caused by forcing zips, buckles, clasps, buttons, studs, eyelets, straps, chains, lace or trims;
  • fit, comfort or sizing issues where the product corresponds with the ordered size;
  • minor colour variation caused by screen settings, lighting or photography;
  • minor manufacturing variations that do not materially affect use of the product;
  • loose threads that can be trimmed without affecting the product;
  • damage caused by perfumes, deodorants, makeup, body oils, chemicals or cleaning products;
  • damage caused by courier handling after a failed delivery caused by customer error; or
  • damage caused by using the Goods for a purpose for which they were not intended.

We may need to inspect the item or refer it to the supplier, manufacturer, importer or another qualified person for assessment.

Where the Goods are confirmed to have a factory defect, we will deal with the matter in accordance with applicable South African consumer law.

Where legally permitted and reasonable, PUNK RAVE will first explore repair or replacement. Where repair or replacement is not possible, not appropriate, unsuccessful, or where a refund is legally required, we will discuss the available remedy with you and comply with applicable law.

No refund, replacement, repair or store credit will be provided for damage caused by customer misuse, normal wear and tear, incorrect care, accident, alteration, unauthorised repair or any cause not attributable to a factory defect.

  1. Return process

To request a return, exchange or defect assessment, email info@punkrave.co.za.

Your request must include:

  • your full name;
  • order number;
  • item name;
  • reason for the request;
  • photos where relevant;
  • whether you are requesting an exchange, store credit, defect assessment or other remedy.

Do not send Goods back without written return authorisation from PUNK RAVE.

If a return is authorised, you must package the Goods securely for transport. Goods damaged during return transport because of poor packaging may be refused or may reduce any store credit or remedy available.

Returned Goods will be inspected before any exchange, store credit, replacement, repair or refund is approved.

PUNK RAVE may refuse a return where the Goods do not meet the return conditions, are excluded from return, have been used or damaged, or are not received within the approved return period.

  1. Courier costs for returns

For non-defective returns, size exchanges, change-of-mind returns or discretionary store-credit returns, all courier costs are for the customer’s account.

For confirmed defective Goods, courier costs will be handled in accordance with applicable law.

If we arrange collection on your behalf for a non-defective return or exchange, the courier cost may be charged to you, deducted from store credit, or required to be paid before the exchange is dispatched.

  1. Restocking fee

Where PUNK RAVE approves a discretionary return of non-defective Goods, we reserve the right to charge a restocking, handling or administration fee of up to 25% of the product price.

This fee may be deducted from any store credit issued.

A restocking fee will not be charged where prohibited by law.

  1. Cancellations

You may request cancellation of an order by emailing info@punkrave.co.za.

A cancellation request is not guaranteed.

Once an order has been accepted, allocated, placed with an international warehouse or supplier, processed, packed, fulfilled, dispatched or handed to a courier, it may not be cancelled except where cancellation is required or permitted by law.

Orders for international warehouse items, special-order items, custom items, made-to-order items, personalised items, pre-order items or items ordered specifically for the customer may not be cancellable once fulfilment has begun, unless applicable law provides otherwise.

If an order is cancelled before acceptance and payment has already been received, we will refund the amount paid for the cancelled Goods.

If only part of an order is cancelled, any refund, store credit or adjustment will apply only to the affected item.

  1. Gift vouchers, coupons and store credit

PUNK RAVE may issue gift vouchers, promotional coupons, discount codes or store credit from time to time.

Gift vouchers, coupons and store credit:

  • may be subject to expiry dates;
  • may be subject to specific terms and conditions;
  • may not be redeemable for cash;
  • may not be transferred unless we agree;
  • may not be used to buy other vouchers unless we allow it;
  • may be limited to one use per customer, per order or per promotion;
  • may be withdrawn, corrected or cancelled if issued in error or used fraudulently; and
  • may not be applied retrospectively after an order has already been placed.

If a coupon or discount code is not applied at checkout, you must contact us before completing payment. We are not obliged to apply coupons retrospectively after an order has been placed.

PUNK RAVE is not responsible for loss, theft, unauthorised use or unauthorised distribution of gift vouchers, coupons or store credit after they have been issued to you.

  1. Promotions, sales and discounted Goods

Promotions, sales, discounts, bundle deals and special offers are available only while stocks last and may be withdrawn at any time.

Discounts may be subject to additional terms displayed on the Website or communicated with the promotion.

Unless otherwise stated:

  • promotional items are subject to stock availability;
  • only one coupon or promotional code may be used per order;
  • discounts cannot be exchanged for cash;
  • promotions cannot be applied retrospectively;
  • sale, clearance, promotional and final-sale items may be excluded from discretionary returns or exchanges; and
  • PUNK RAVE may cancel or correct a promotion where there is an error, abuse, fraud or unauthorised use.
  1. Personal information and privacy

We respect your privacy and will take reasonable measures to protect your personal information.

When you use the Website, create an account, place an order, subscribe to marketing, contact us, enter a promotion or interact with us, we may collect and process personal information including:

  • your name and surname;
  • email address;
  • phone number;
  • billing address;
  • delivery address;
  • payment status and transaction references;
  • order history;
  • account information;
  • communication records;
  • marketing preferences;
  • device, browser and Website usage information; and
  • any other information reasonably required for our business operations.

We process personal information for purposes including:

  • creating and managing customer accounts;
  • processing orders;
  • verifying payment;
  • fulfilling and delivering orders;
  • communicating with customers;
  • providing customer support;
  • processing returns, exchanges and defect assessments;
  • preventing fraud and abuse;
  • complying with legal and tax obligations;
  • improving our Website and product offering;
  • sending marketing communications where permitted; and
  • operating our ecommerce business.

We may share personal information with service providers who assist us, including payment gateways, couriers, international warehouses, suppliers, IT providers, hosting providers, email platforms, marketing platforms, fraud-prevention providers, professional advisers, regulators or authorities where required by law.

Where orders are fulfilled through an international warehouse or supplier, your personal information may be shared with parties outside South Africa where necessary to process, fulfil or deliver your order.

Our Privacy Policy contains more information about how we collect, use, store, share and protect personal information. The Privacy Policy forms part of these Terms and Conditions and is available on the Website.

  1. Cookies

The Website may use cookies and similar technologies to improve functionality, remember user preferences, analyse Website traffic, support ecommerce functions, assist with marketing and improve customer experience.

You may disable cookies in your browser settings, but doing so may affect the functionality of the Website and may prevent you from using certain features, including account login or checkout.

  1. Electronic communications

By using the Website, creating an account, placing an order, sending us an email, or otherwise communicating with us electronically, you consent to receiving communications from us electronically.

Electronic communications may include:

  • order confirmations;
  • payment confirmations;
  • fulfilment updates;
  • delivery updates;
  • return and exchange communications;
  • customer service messages;
  • legal notices;
  • account notices;
  • marketing communications where permitted; and
  • Website or policy updates.

You may opt out of marketing emails by using the unsubscribe link provided in the email or by contacting us. Opting out of marketing communications does not stop transactional or service-related communications about your orders or account.

  1. Reviews, comments and user content

If you submit a review, rating, comment, photo, testimonial or other content to PUNK RAVE or the Website, you grant us permission to use, reproduce, publish, edit and display that content for Website, marketing, social media and business purposes.

You must not submit content that is false, unlawful, defamatory, abusive, obscene, infringing, misleading or harmful.

We may moderate, remove or refuse to publish user content at our discretion.

All Website content, including text, images, graphics, icons, logos, trade names, trademarks, product images, page layouts, designs, software, videos, audio, databases and other material, is owned by or licensed to PUNK RAVE and is protected by South African and international intellectual property laws.

You may not copy, reproduce, distribute, adapt, publish, display, sell, scrape, reverse engineer, commercially exploit or otherwise use any Website content without our prior written consent, except as permitted by law.

Nothing on the Website gives you any right, title or interest in our intellectual property or the intellectual property of our suppliers, licensors or partners.

To the maximum extent permitted by law, PUNK RAVE will not be liable for any indirect, incidental, special, consequential or punitive loss or damages, including loss of profit, loss of enjoyment, loss of opportunity, loss of event attendance, loss of travel costs, loss of booking fees, loss of photoshoot fees, loss of performance fees, emotional distress, disappointment, reputational harm or any other indirect loss arising from the use of the Website, purchase of Goods, delivery delays or missed deadlines.

This limitation does not apply where liability cannot lawfully be limited or excluded.

  1. Indemnity

You agree to indemnify and hold PUNK RAVE harmless against any loss, claim, damage, liability, cost or expense arising from:
